Booking conditions

Please read this section carefully. It is an important part of the contract between you and Genius
Loci Travel, with respective rights & obligations. Bookings are accepted only in accordance with
the present Terms & Conditions.

Genius Loci Travel is a fully licensed tour operator and a registered company (P. IVA / V.A.T. Reg .N.°. 03800410650), based in Via A. Rotondo, 5 – Salerno/Italy (European Union). Registration N.°. 321365 of the Chamber of Commerce of Salerno.

1. How to book and pay for your holiday

A first reservation of your place on one of our tours can be made in several ways: directly via our website (using the booking form provided), by sending an e-mail or by phone. We’ll then ask you to fill out the booking form, with which we make a first reservation. This reservation is valid for 7 days, after which we no longer hold your place. By sending us your booking form you agree upon the  present booking conditions.

To confirm your booking you need to pay a deposit of 25% of the selected holiday. This can be done by credit card or by money order/bank transfer.
If you pay by credit card please note that we accept VISA and Mastercard.

Your booking is confirmed when you receive a written confirmation stating that you have paid the deposit and consequently a contract between us comes into existence. When you receive the confirmation, please check details carefully and inform us immediately should anything be incorrect.
Full payment is due not later than 6 weeks before departure (42 days). If we do not receive all payments due in full and on time, we reserve the right to treat your booking as cancelled and cancellation charges will apply. Late bookings (less than 6 weeks before departure) are subject to availability and full payment is required at the time of booking.

Please note that at the time of writing special cancellation fees apply due to Covid- 19 pandemic.

2. Prices

All prices we advertise on this website are accurate and are updated regularly. In the very unlikely event of major price changes beyond Genius Loci Travel’s control, we reserve the right to change  any of them (whether or not you have paid only a deposit or the full holiday cost). Before you finalise your booking you will receive the up-to-date tour price, including the extra costs for any  additional service, or upgrade requested. Any increase in tour prices must be paid prior to departure, any decrease will be refunded prior to departure.
If we impose a surcharge, which means paying more than 8% of your holiday price, you will be entitled to cancel your holiday with a full refund of all monies paid to us except for any amendment charges. Should you decide to cancel accordingly you must exercise your right to do so within 14 days of the date of our surcharge invoice.
All tour prices mentioned are per person and on twin share basis (unless otherwise stated).

3. If you have to alter

Please note that all booking amendments are subject to availability of all suppliers providing the services included in your selected travel package.

If you wish to change for any personal reason your booking in any way we will do our best to make it possible.
If notification is received later than the term indicated the below cancellation charges will apply.

4. If you have to cancel

If you have to cancel your holiday we must receive notification of it in writing and the following cancellation fees will apply:

  • 41 – 28 days before departure Loss of deposit
  • 27 – 16 days before departure 50% of the tour price
  • 15 – 8 days before departure 75% of the tour price
  • 7 or fewer days before departure 100% of the tour price

Please understand that a fee of only € 100 will be charged to cover administration costs if your cancellation request is received by Genius Loci Travel more than 41 days prior to the original departure dates.

5. If we have to cancel or alter

In the unlikely event that Genius Loci Travel has to cancel your holiday, you can receive a full reimbursement of the tour cost, or if you wish, we will give you the chance to transfer to an alternative
holiday (if the price is lower, we will refund the difference, if it is slightly higher, we will not charge you the additional amount; if it is significantly higher you may be charged an additional  amount). Although we plan your travel arrangements long in advance, changes to the itinerary may occur, even after the tour has started, due to local circumstances. You acknowledge that  travelling requires a certain grade of flexibility, due to the nature of the tours we organise. Sometimes changes may be made to the itinerary due to Force Majeure, weather conditions, poor state of the paths (treks), changes in transport schedules, vehicle breakdown, etc.
Genius Loci Travel reserves the right to substitute hotels, restaurants, routes or other services listed in the itinerary with comparable services if necessary.

Cancellation of group tours due to low tour booking numbers: Genius Loci Travel reserves the right to cancel any tour prior to departure in the event that too few people are booked on a tour, as operation of all tours is dependent on a minimum number of persons booking the tour. If that number is not achieved, we reserve the right to cancel the tour. In no circumstances will we cancel your tour less than 4 weeks before the scheduled departure date except for reasons of late cancellations from other passengers on your departure, force majeure (as defined below) or failure on your part to pay the final balance. In this case you will be given a full refund of the tour price. You will not be entitled to claim any additional amounts or compensation for any loss which may result from this cancellation. We will however do everything possible to find you a suitable alternative tour (see above).

We would like to reassure about our flexible terms and conditions in these difficult times!

If you have to postpone your travel arrangements due to Covid-19 restrictions until 2 weeks before departure, you can use the amount paid on your next holiday (until fall 2022).
No fee will be applied, we will only deduct any unrecoverable cost!

If you have to cancel your holiday due to Covid-19 restrictions you can do it up to 28 days before departure, we will not charge any cancellation fee unless there are unrecoverable costs that you have acknowledged at the time of reservation.

6. Health, Fitness and Age Limits

Activities involved in active travel may be physically demanding, strenuous and potentially dangerous. By booking with us, you acknowledge that you are in suitable physical and mental condition to perform the activities described herein.

7. Insurance

It is a condition of booking to provide us with a valid and adequate travel insurance. It is strongly recommended to check that the insurance you hold has been specially tailored to cover all  activities undertaken as part of your holiday, as well as medical risks (including any risk related to pre-existing medical conditions, emergency repatriation including helicopter rescue and air ambulance where applicable, and liability) and cancellation risks. Please note! Several traditional insurance companies have expanded or adapted their existing coverage for travellers to offer a more comprehensive coverage during the pandemic Covid-19 (such as quarantine before departure, extra costs in the destination due to Covid illness, etc). A “Cancel for Any Reason” insurance may offer the most trip cancellation flexibility, we do recommend to check with your insurance the coverage type and read carefully insurance conditions before subscription.

8. (Exclusion of) Liability

Our obligations (and those of our suppliers in providing any service or facility included in your tour), are to take reasonable skill and care to arrange for the provision of such services and facilities. You must show that reasonable skill and care has not been used if you wish to make any claim. Genius Loci Travel will not accept any responsibility if you contravene any law or regulation of the country or the region visited. You acknowledge that any optional activity you may undertake during the trip is completely at your own risk. Genius Loci Travel, its agents, servants and employees shall not be responsible for personal injuries or property damage, loss or delay, or change of itinerary incurred by any person or tour participant arising out of the act of negligence of others nor shall Genius Loci Travel be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of Genius Loci Travel, any agent or supplier, or due to force majeure.
Bicycles and sea kayaks (where applicable) provided are in satisfactory operating condition and you agree to use them at your own risk. Should you notice any damage compromising its safety you must report it immediately to the tour leader or to our office. You are required to wear a helmet while cycling. Genius Loci Travel will not accept responsibility should you not accomplish such requirements. Participants in walking tours are required to use proper walking shoes.

9. Complaints

Our priority is to give you a great holiday and we work hard to make this happen. However, if you are not happy with any of the travel arrangements or there is anything about which you may wish to complain you should report it immediately, either to your tour leader (group tours) or to our office, so that the problem can be immediately sorted. If we are unable to help and you still have a complaint you should report it in writing to us within 30 days of your return.

10. Tour Participation and Conditions of Exclusion

Genius Loci Travel reserves the right to decline to accept or retain as a client, anyone whose conduct is disruptive to the enjoyment of other clients, or whose behaviour may cause prejudice to the good reputation of Genius Loci Travel.
On group tours you acknowledge the authority of the tour leader in all matters that are likely to affect the safety and well-being of the trip. Genius Loci Travel (by tour leader or representative) reserves the right to terminate this contract in case you refuse to comply with Tour Leader decisions on such matters. In these cases no refund will be applicable.

11. Your contract

Your contract with us is governed is governed by the Tourism Code (art.32-51 novies) as amended by Legislative Decree 21 May 2018, n. 62 as well as the provisions of the Civil Code on the subject of transport and mandate, as applicable. In the event of a financial failure, the Fondo di Garanzia FOGAR (ex art. 47 del Codice del Turismo – D.lgs 23.5.2011, n. 79, as modified by D.Lgs 21.5.2018, n. 62) – Ref. Insurance Policy TUA ASSICURAZIONI N. 40321512001546 will enable customers to get reimbursement of the cost of the travel package, when the financial failure of the travel agent has not allowed costumer to start or continue their holiday.
Any dispute arising shall be subject to Italian Court.
